BMG faces a patent infringement lawsuit filed by Muvox LLC in Texas over its song-selection methodology used in BMG Synch. The lawsuit centers on a patented method for selecting songs based on mood correlation with other similar tracks.

The disputed patent specifically covers techniques for matching songs by "checking the one or more moods of the song against at least one other mood identification technique for a level of correlation" with other songs. The patent is currently assigned to Aperture Investments LLC, which holds approximately 15 patents related to music categorization and organization.

BMG Synch, the service in question, is a digital platform that enables clients to license music for synchronization purposes, offering a comprehensive catalog of music across various genres.

In a parallel case, Muvox has also filed a lawsuit against IBM for allegedly copying elements of its mood-based music recommendation patent in their AI and machine learning-powered music program.

This case follows similar patent infringement lawsuits filed by Blue Spike LLC against Warner Music Group and Universal Music Group in 2023, which focused on digital content encoding and distribution patents.
