Tool's first 'Live in the Sand' destination festival has sparked controversy, with fans considering a class action lawsuit due to similar setlists across two consecutive performances on March 7-8 at the Hard Rock Hotel in Punta Cana, Dominican Republic.

Four songs were repeated both nights: "Fear Inoculum," "Rosetta Stoned," "Pneuma," and "Jambi." With tickets costing between $4,000-$10,000, fans expected completely different setlists each night.

Law firm Stas Rusek is investigating a potential class action lawsuit for breach of contract and misrepresentation. The firm's principal attorney, Stas Rusek, attended the festival himself and is seeking other disappointed attendees for representation.

Neither Tool nor frontman Maynard James Keenan have commented on the controversy. The band has moved on to their first Latin American headlining tour, performing in Mexico City, Guadalajara, Buenos Aires, Santiago, Bogotá, and São Paulo.
